These Terms of Use ("Terms") are a binding agreement between you and the solo independent developer of OVERDRIVE ("OVERDRIVE," "we," "us," or "our") governing your download and use of the OVERDRIVE iOS application (the "App"). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

**OVERDRIVE is a game about driving *well*, not driving *fast*. Your safety, and the safety of everyone around you, comes before anything in this App.**
By using OVERDRIVE you acknowledge and agree to all of the following:
1. Never interact with your phone while the vehicle is moving. OVERDRIVE is designed to be hands-free: recording, discovery, and Flow scoring are fully automatic and require no taps while you drive. Set up your drive before you move, mount your phone safely, and do not look at, tap, or hold your device while driving.
2. Obey all traffic laws at all times. Speed limits, signals, signs, right-of-way, seatbelt and mounting laws, and every other rule of the road always take priority over anything in the App. Nothing in OVERDRIVE is an instruction, encouragement, or permission to break any law.
3. The App never rewards speeding on public roads. On public roads, OVERDRIVE scores smoothness (steady pace, gentle inputs) and discovery — never speed, never time, never drift. Driving faster can never raise your Flow score. There are no speed or drift leaderboards, points, rewards, or competitions on public roads, and there never will be.
4. Timed and competitive driving is limited to verified closed venues only. Lap times, speed zones, and drift scoring exist exclusively when geofenced to verified racetracks and permitted, closed-course events. Never attempt any timed, speed, or drift activity on a public road. Any private "top speed" figure is a personal statistic only — it is never ranked, shared, or made competitive.
5. Convoys are private and invite-only. OVERDRIVE does not publish public meet-ups or facilitate gatherings on public roads. You are solely responsible for how you and others actually drive.
6. You assume all risk of driving. Driving is inherently dangerous. You — and only you — are responsible for operating your vehicle safely and lawfully. You are responsible for choosing when it is safe to record, mount your device, and use the App. If conditions are unsafe, stop using the App.
7. Do not use the App to race, street-race, drift, evade law enforcement, or drive recklessly on any public road. Doing so violates these Terms, may be a crime, and endangers lives.
If following the game in any way would require you to drive unsafely or unlawfully — don't. The road always wins. Turn it into a good drive, not a fast one.
You use OVERDRIVE entirely at your own risk. To the fullest extent permitted by law, we are not liable for any accident, injury, death, property damage, traffic citation, loss, or other harm arising from your driving or your use of the App. (See Sections 11–12.)
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App on Apple-branded devices that you own or control, for your personal, non-commercial use, consistent with the Apple Media Services Terms and the Usage Rules in the App Store Terms of Service. This license does not allow you to resell, redistribute, or commercially exploit the App.
You must be at least 17 years old and a validly licensed driver (or a lawful passenger) to use OVERDRIVE. By using the App you represent that you meet these requirements and that you will only use the App in a vehicle you are legally permitted to operate, or as a passenger.
You agree not to:
We may suspend or terminate your access for violations, and — when community features exist — remove content and, where required for a UGC feature, provide reporting, blocking, and moderation tools.
Any content you create in the App (profile details, car info, reports, and — when enabled — zones, tracks, crews, and convoys) is your responsibility. You represent that you have the rights to it and that it is lawful. You grant us a limited license to store and display it as needed to operate the features you use. We may remove content that violates these Terms.
OVERDRIVE requires an auto-renewing subscription ("OVERDRIVE Pro") to use the app — there is no free tier. All purchases are made through Apple In-App Purchase — Apple is the merchant and processes all billing.

Auto-renewal disclosure (please read carefully):
We present trial length, the price after any trial, the billing frequency, the auto-renewing nature, and how to cancel clearly and before you subscribe. If anything about a plan is unclear, do not purchase — email us first at [email protected].
Some features are free; some may require a subscription. We may add, change, suspend, or remove features over time — including online features (leaderboards, crews, convoys, community zones) that are not present in the current release. We may also discontinue the App. We are not liable for changes to, or discontinuation of, any feature.
The App uses third-party services (including OSRM map-matching, CARTO / OpenStreetMap map tiles, and — when enabled — Apple, RevenueCat, and Supabase) as described in our Privacy Policy. Your use of those services is also subject to their terms, and map data is © OpenStreetMap contributors © CARTO. We are not responsible for third-party services.
The App, its design, brand, code, and content (excluding your user content and third-party map data) are owned by us and protected by law. These Terms grant you a license to use the App, not any ownership of it.
OVERDRIVE is an entertainment and gamification app. It is not a navigation system, a driver-assistance system, or a safety device. Map data, discovery, distances, and scores may be inaccurate, delayed, or incomplete. Do not rely on the App for routing, navigation, hazard warnings, or any safety-critical decision. Always use your own eyes and judgment on the road.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, accurate, or secure. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, ACCIDENT, PROPERTY DAMAGE, TRAFFIC CITATION, OR LOSS ARISING OUT OF OR RELATING TO YOUR DRIVING OR YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY. YOU ASSUME ALL RISK ASSOCIATED WITH OPERATING A VEHICLE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (via Apple) FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. Some jurisdictions do not allow certain limitations, so some may not apply to you; nothing in these Terms limits liability that cannot be limited by law.
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your driving, your content, or your violation of these Terms or of any law or third-party right.
You may stop using the App and delete it at any time. We may suspend or terminate your license if you violate these Terms. Sections that by their nature should survive (including Safety, Disclaimers, Limitation of Liability, and Indemnification) survive termination.
This App is licensed, not sold, to you, and this license is subject to the Apple Licensed Application End User License Agreement (Standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, as supplemented by these Terms. In the event of a conflict, Apple's Standard EULA governs the Apple-specific points below.
You acknowledge and agree that:
These Terms are governed by the laws applicable at our place of residence as the developer, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection laws of your country of residence that cannot be waived. You agree to first try to resolve any dispute informally by emailing [email protected]. Nothing here deprives you of the protection of mandatory local law.
We may update these Terms as the App evolves (for example, when accounts, online features, or purchases are enabled). We will update the "Last updated" date and, for material changes, provide notice in the App. Continued use after changes means you accept them.
